The Cost of a Ski Accident Personal Injury Lawyer

How much does a skiing accident personal injury lawyer cost? Nearly all personal injury attorneys charge a contingency fee for personal injury cases. What does that mean?

It means that unless and until there is a recovery either through settlement or jury award, you don’t have to pay for the work the attorney performs. Payment of any fees is contingent on obtaining a settlement or jury award. Said another way – there’s no upfront fees to handle your claim, but if you win your claim, the attorney will take a percentage of the result. Depending on the facts of a case, I typically have a sliding fee contingency fee arrangement. If I’m able to settle your case without litigation I charge a 33% contingency fee. In the event that your case cannot be resolved without filing a lawsuit my fee is 40%. The higher fee reflects the tremendous amount of additional work that must be performed in the course of litigation and preparation for trial.

Does Your Contingency Fee Cover Costs?

My fee does not include costs. Just as you pay for labor and materials when you have work done on your car or a new roof put on your house, the client is responsible for ‘materials’ used in their case. This doesn’t mean paperclips, envelopes, faxes or any other item that is properly my cost of doing business. I do not have a built in cost just for opening your file as some lawyers do. Personal injury fees are contingency based so clients can hire an attorney without having to pay legal fees up front. If your claim is unsuccessful, you may owe for expenses related to your case. What are the ‘materials’ or expenses? These can vary a lot depending on the case. Expenses may include private investigators, medical record retrieval, and experts. Most cases utilize your treating doctors as experts. Orthopedic surgeons, for example, typically charge $3000-$6000 to come to court and testify. This is in addition to any charges for writing opinions outside of whatever is in the medical records. Your case may require additional information on future medical treatment and costs and/ord impairment to living a full and complete life. Other expenses may be for medical illustrations or videos that help demonstrate how the injuries occurred and what the injuries look like.

Injury law is the only thing I do. I don’t review contracts. I don’t do real estate deals or divorces. One hundred percent of the work I perform is on a contingency fee basis.
